Recognition of Professional Qualification of EU

 Recognition of Professional Qualifications of EU and other EEA nationals

* Who can apply for recognition of a professional qualification in the Czech Republic?

Any EU and EEA national who gained their professional qualification in the EU or in the EEA outside the Czech Republic.

* What should an applicant do?

First, an applicant should find out if the profession or activity that they want to practise is a regulated profession or activity.

A regulated profession or activity is a profession or activity, the practise of which, in the form intended by the applicant, requires evidence of education or attestation of competence.

If a profession or activity which an EU or EEA national intends to practise in the Czech Republic is not regulated they are allowed to practise it without recognition of a professional qualification.

If a profession or activity which an EU or EEA national intends to practise in the Czech Republic is regulated they are obliged to apply for recognition of a professional qualification at the recognition authority.

The recognition authority for the recognition of a professional qualification in an individual case is a central administrative body with competence in the field of a regulated profession, or whose competence is the closest to the field of the regulated profession. If the applicant wishes to practise a regulated activity as an entrepreneur in the form of „ trade", or as an agent in trade acting under the authority to the holder of a trade licence responsible for the practise of the trade, the recognition authority is the Ministry of Industry and Trade. If the right to practise a regulated profession is granted by the decision of a professional association, the recognition authority is that professional association.

* How shall an applicant proceed?

An applicant should fill in the application for recognition of a professional qualification which can be found on the web site: www.msmt.cz. They should send the completed application and requested documents to the recognition authority responsible for the regulated profession or activity that an applicant wishes to practise.

An applicant should state

  • first name, surname, date of birth, nationality and mailing address
  • the regulated profession they wish to practise in the Czech Republic
  • the form of intention for the practise of a regulated activity (an entrepreneur, an employee)

The application should be supported by

  • an identity card and/or proof of nationality
  • evidence of professional qualifications
  • evidence of other competence

* What does the recognition authority do?

A recognition authority shall issue a decision on the application within 90 days of submission of a complete application, including relevant documents. In very difficult cases or cases where it is necessary to seek information from the relevant authority in another Member State, the recognition body shall decide within 120 days.

The recognition authority can issue a decision which states that:

  • professional qualification is recognised
  • the recognition body requires an accomplishment of compensatory measures (practise of the activity for a required length of time, the completion or pass of a probationary period, or the need to pass an examination proving competence)
  • the application for recognition of a professional qualification is rejected

Appeals against the decision of recognition authority can be made.

* What is the relevant Czech legislation?

Recognition of professional qualifications is regulated by Act No 18/2004 Coll., on the recognition of professional qualifications and other competence of nationals of Member States of the European Union and on the amendment of some acts (Act on the recognition of professional qualifications). The procedure is regulated by Act No 71/1967 Coll., on administrative procedure (Administrative Act), with variations in the Act on the recognition of professional qualifications.

This procedure is used only where the applicant is fully qualified to practise the regulated profession or the activity in the country of origin or in the country of residence or in the state where an applicant has practised the regulated profession or the activity.
